Landfill space is valuable and should be reserved for materials that cannot readily be recycled. Wisconsin law prohibits landfill disposal or incineration of recyclable paper products, food and beverage containers, electronic devices, oil filters and most hazardous wastes. Because these recyclable materials may serve as industrial feedstocks, recovering more of them is in everyone’s interest, moreover, it may help preserve manufacturing jobs in Wisconsin and elsewhere in the United States. Section 287.07, Wis. Stats., and ch. NR 506.095, Wis. Adm. Code, prohibit disposal of certain recyclable materials in Wisconsin landfills. The paragraphs below provide more details. For a more comprehensive list of banned items from landfills and incineration see the DNR flyer: Click here.

Electronics Banned from Wisconsin Landfills

As of September 1, 2010 many common electronics devices are banned from landfill or incinerator disposal in Wisconsin. This is required by WI Act 50, which was passed in 2009.

WI Act 50 also requires manufacturers to provide a recycling network for these electronic devices. Visit the WI DNR's website for more information about the statewide program and a list of recycling collection locations. You may also visit Dane County's recycling website for a list of Dane County electronics recyclers.

Section 287.07(5), Wis. Stat., prohibits disposal of most electronic devices in Wisconsin landfills, burning or an incineration facility, or placing these devices in a container intended for disposal or incineration. For more information about this law, visit http://dnr.wi.gov/topic/Ecycle/

Oil Filters Banned From Wisconsin Landfills

As of January 1, 2011 used automotive engine oil filters are banned from Wisconsin landfills. This is required by 2009 Wisconsin Act 86, which was passed in 2009 to promote oil recycling and protect the environment.

No individual or group is exempt from this ban. For more information on this ban, please visit this DNR website: http://dnr.wi.gov/files/pdf/pubs/wa/wa1503.pdf

Section 287.07(4m), Wis. Stats., prohibits disposal in a solid waste disposal facility of used oil filters or oil absorbent materials that contain free-flowing waste oil. For more information about this law, visit http://dnr.wi.gov/topic/recycling/oil.html.

Hazardous Waste

Dane County Landfill does not accept hazardous waste. Hazardous waste is identified in ch. NR 661, Wis. Adm. Code. Section 291.21, Wis. Stats., requires that the waste generator determine whether a material is hazardous waste, and if it is, the generator must arrange for the transportation, storage and disposal of the waste at a state or federally licensed hazardous waste facility. For more information about this law, visit http://dnr.wi.gov/topic/Waste/Hazardous.html to find a link to the publication “Is Your Waste Hazardous.”

Yard Waste

Yard waste, is a critical material of Wisconsin’s composting industry, it is banned from landfills. Section 287.07(7)(cm), Wis. Stats., allows disposal of certain plants classified by the DNR as invasive species if the plants are separated from other yard waste. See species regulated by NR 40 more information.
